Crashworthiness Litigation: Principles and Proofs

Abstract
This article explains fundamental legal principles applied in automobile crashworthiness litigation. It reviews landmark cases and important new court decisions that specify what the plaintiff must prove to prevail. Proof that plaintiff suffered an “enhanced injury’ is essential. The article describes what “enhanced injury” means, how it must be proven, and why expert testimony is vital.
